The courtroom saga of Brindi the dog may soon be over.

A provincial court judge Tuesday fined owner Francesca Rogier $600 and ordered ownership of the dog transferred to the Halifax Regional Municipality in the latest chapter of a protracted battle over the dog’s fate.

However, Judge Flora Buchan stopped short of ordering the dog destroyed.

Buchan said Brindi should be treated like any other dog by the municipality and should be trained and adopted out if possible.

However, the possibility exists that the animal could be euthanized, but that will only happen if an assessment shows her behaviour can’t be changed and she isn’t adopted.

Brindi was seized from Rogier in September 2010 after the dog attacked another canine.

Rogier was found guilty earlier this spring of allowing a dog to run at large, failing to comply with an order to muzzle Brindi and owning a dog that attacks an animal.

It was the second time nine-year-old Brindi had been seized by animal control. She was previously picked up in 2008 after attacking another dog and was ordered euthanized.

However, Rogier successfully appealed and the dog was ordered to be returned to her with conditions that included keeping the dog muzzled in public, building a fence in her backyard and having the dog trained.

The second incident happened only two months after Rogier got the dog back.

While there was no evidence Brindi is beyond redemption, “sadly” that is not the case with her owner, Buchan said.

“I would describe Ms. Rogier as an irresponsible pet owner who has known since she (adopted) Brindi that she has control issues,” the judge said, while also calling her “unrepentant.”

In ordering Brindi’s ownership transferred to the municipality, Buchan said the dog “cannot safely be returned to Ms. Rogier.”

Rogier did not appear in court. Instead, she called dog trainer Susan Jordan shortly before her sentencing was due to start and asked her to appear on her behalf.

Jordan, who has worked with Brindi and Rogier, said she thinks Rogier didn’t show because she expected the emotions of the day to be too much for her.

“I think ... it was going to take more of a toll than she was prepared (to handle),” Jordan said. “To come out after that and try to be coherent and deal with the repercussions ... would be a little more than she could handle.”

She said she was pleased the court didn’t opt to immediately euthanize Brindi.

“I’ve trained and worked with the dog,” Jordan said. “This dog certainly has behavioural concerns. (It) needs modification training, but the dog is trainable.”

She said she has seen seen dogs with similar issues throughout the municipality.

Jordan said she last assessed Brindi two weeks ago and in all aspects, except territorial concerns, “this is a highly adoptable dog.”

An effort to contact Rogier through Jordan was unsuccessful.

While the the city sought an order to have Brindi destroyed, Katherine Salsman, the municipality’s lawyer, said the judge’s decision “is the best of both worlds.”

“It allows us to evaluate and ensure (if adoption) is the right decision to be made, ... but it still gives us the option to put the dog down if public safety reasons do require it.”

The order doesn’t take effect until Aug. 21 to allow time for an appeal.

The case of Brindi the dog may well be over.

Hate to say but the Justice system does work in CANADA

The Halifax woman behind a high-profile battle over her dog was found guilty on all three counts relating to 2010 attack on a neighbour's pet Thursday.

Halifax Regional Municipality asked that Francesca Rogier's dog, Brindi, be put down.

Rogier said the 2010 attack near her home in East Chezzetcook was not serious. "They were flesh wounds. They didn't go deep into the fatty tissue," she told CBC News outside the court.

Brindi jumped out of the window of Rogier's car and sank its teeth into a neighbour's smaller dog. The attacked dog was on a leashed walk with its owners. Brindi had recently been released after an earlier attack on another dog.

The judge ruled the 2010 attack broke three bylaws because Brindi was running at large and attacked another dog when Brindi was supposed to be wearing a muzzle.

The dog was seized after the attack and is still at the city pound. The city argued Brindi should be destroyed.

"They would never have seized her in the first place if they didn't want to kill her," Rogier said.

Rogier's dog first got into trouble when it attacked another dog in 2008. Rogier fought a long and costly court battle to save her pet.

A court spared Brindi but imposed several conditions. Rogier was ordered to take a training course with her dog and muzzle her pet if it wasn't in a fenced-in area.

The judge warned that Brindi would likely be put to death if there was another attack.

Rogier said she plans to appeal the decision, arguing there were "strong charter" issues at play. She will be sentenced at the end of June. The dog's fate will be decided at the same time.

I posted the comment,but thought I would just put it up as a topic as well, of course the idiot would not use their name probably to hide just how stupid they actually are.This want to be lawyer needs a lesson in CANADIAN LAW,Fraud,hate crimes,threatening,well the author of that comment better look in the mirror as it seems that the threats are not made by this blogger but by some of fran's Idiot friends or in many cases by Fran herself. Yes several of us have called HRM,Immigration,CRA,and the IRS,in fact all of the Gov depts have hot lines for reporting suspected violations maybe the writer of the comment should actually look it up before blowing smoke out their ass.

THE WAY TO BE ACCEPTED IN A NEW COMMUNITY.... NOT

Well as most everyone knows Ms.Rogier lives in Nova Scotia as a guest of the Canadian Government,and wishes to live there as a landed immigrant and I suspect would like to fit in to the community which she claims to like....well now wait a minute Ms Rogier posted this on her Face book page. ""Francesca Rogier People really need to understand just how dysfunctional the whole place is. It's not saying that I'm perfect in every way, in any way. But dysfunction and corruption cannot be escaped at these levels."" Now I can't speak for anyone else but if I wanted to move to a new country, I would not pick an area as Frannie describes,and if I did I would not make statements like the above on a public chat page which will just turn off the people of this great Province. IMO its not the way to fit into a community. Than there is the issue that Ms Rogier will not live by the laws of the community even when under a court order, and she thinks its us the residents of NS that are dysfunctional? I suggest Rogier looks into a mirror.

Now this was sent to Wayne by Robert Riley, we all know RR,remember he the guy, (witness)that fell from the sky and has eyes in the back of his head,at least he did the night Brindi attacked a smaller dog.
Oh but hang on the plot thickens,RR sent the link to Wayne....But now did he?....OH Hell NO it came from Fran's I will disclose how I know that for a fact in due course. Now something else that was noticed was the Blog was created by Fran herself,just as she created Humane Halifax,save Brindi,and countless other blogs and FB groups,to say nothing of twitter accounts Hell most of her crap is on this blog.
I am putting this out there just to show everyone that Ms Rogier is a user,Hell Rogier even called Robert Riley a drunk who couldn't be trusted its all in one of the tapes where she called HRM dispatch,well that probably is the case and if in fact it is the case; Why would Fran still associate with the likes?...... Yep you got it to use him for personal gain.
Further if one looks at the members in her open FBG one may discover that at least 3/4 of the members couldn't find Nova Scotia on a map let alone HRM Further the vast majority of members couldn't give a rats ass about Fran or Brindi, another classic example of people being used for personal gain,and just maybe a few of her suckers will donate to her paypal account.

To sum up its my opinion that Fran is just using Brindi as a meal ticket,as its no longer about the dog but Ms Rogier herself.Once brindi is hopefully re homed Rogier will have to have another cause to raise money,hopefully people won't be to gullable to be sucked in yet again.
