In March 2012, Brindi's owner, Francesca Rogier, will be put on trial for by-law infractions stemming from a minor scuffle with a dog in front of her house on September 14, 2010. The dog was not seriously harmed. The owners were related to the people who first reported Brindi to the city, and one of them works for the ...city of Halifax.
If the court finds Francesca guilty on any charge, the prosecutor for Halifax will invoke a law allowing the court to order a dog put down as an "additional penalty".
BACKGROUND
In this case, Halifax is seeking a court order to kill Brindi as an “additional penalty”. This is a repeat of the first trial, where her owner was charged for three by-law violations – six months after the event, and immediately after the city lost its case in supreme court, but refused to return Brindi.
DOG LAW MUST BE ENFORCED USING REASON AND DISCRETION
Cities have a role to insure public safety, but within reason: they must also treat dogs and owners fairly. By-law infractions are minor offenses that are meant to be fined. Killing a dog is not a fair or moral penalty for any by-law infraction. If a city seeks to kill a dog it says is dangerous, it must present proper grounds. It must have proof that it has attacked with the intent to kill or do serious harm. It cannot fairly ask for “pre-emptive” action. Dogs that fight dogs are not necessarily a threat to public safety (dogs are not part of the public – if they were, they would have rights!). Dogs typically fight dogs as a way to establish dominance. It is no indication they will attack humans. And dogs can be trained out of this behavior. Fatalities due to dog attacks rank very low on the list of causes of accidental death and injury. They are not even among the top fifty.

(An animal control officer will testify, but she is not qualified in dog training and behavior.) Clearly Halifax is not pursuing this case in the interest of public safety.

Well SFB you got it somewhat right,but left out the leash bit as ordered by the Judge,however that is a mute point as Brindi was not even wearing a muzzle,during the last attack,let alone the leash. Of course accidents happen but lets look at it this way,you do drive through a red light and kill someone,yes its an accident however you will be charged and in all likely hood be found guilty; now do the same thing a few months later and kill another person,what in fuck are you going to do stand in front of the Judge and say it was just an accident,oh I'm sure the Judge will say ok it was just an accident so you are free to go....Like HELL SFB,you will pay the price,however in Brindi's case She will pay the price and you will get lots of media attention; IMO its you that should be locked up and Brindi should be free to run in the country on a large farm, Now go back to ONS and try to impress them, BTY I see you arn't doing to good there,on the tapes I seen you seem to be brushed off as a real nut case....what can I say but if it looks like a duck,walks like a duck,must be a duck,just change duck to nut and you will get it.

Francesca Rogier I believe it is absolute BS to detain James for two days, just as it was last week to detain the three of them for the rest of the weekend. It's called unlawful detention, habeas corpus; etc. Last Monday, a judge ruled that Rattrap's charges of obstruction of justice and violating his conditions were satisfied by "time served" and he was released - sounds fair, unless you consider that the charges and conditions were unreasonable and unfounded in the first place!

Francesca Rogier FYI, A friend of mine got falsely arrested for criminal harassment after arguing with the SPCA shelter manager (two squad cars pulled him over!); very serious charge and hard to prove after one altercation with a stranger. By the next morning, when his lawyer contacted the police, they had already decided to drop the charges..

At 3:50 today, James Wiseman called me to say he'd been arrested again for entering Cornwallis (i.e. Peace and Freedom) Park. As he was walking home, the police picked him up. He needed someone to sign for him so he could be released, so I left immediately. I got to the police station at 4:25, and was told that they were 'busy', so he was not ready to be released and they would call me when he was. If it's not before 7, he'll be held overnight...send good thoughts his way..let's hope they call soon so I can go and get him and he's not stuck there overnight!!

Francesca Rogier Amanda, it's up to you to decide what's best here, but if I can make some suggestions, if you can get back there and ask to speak to the officer in command - if they want to know why, say it's because you are very concerned about James' condition. If you can get to that person, work with him as well as possible: start with reasonable questions such as would they give him food if it was dropped off; express concerns for his health as he has lost weight recently, has little money to buy food, etc. (both true).

Rick Van Wrinkle IMHO James should ask the Sargent on duty to have a doctor check him out as they didn't give him a proper check up at the hospital he went to. He said that he might have a concussion but they can't tell. They sure as hell can tell if happens to a hockey player. I would suggest that if no one takes him to the hospital to get checked out for the pains he has been experiencing then someone should write down the symptoms of what he has been experiencing and e-mail these to all city councillors and demand that this man be checked out properly for these injuries.

Amanda Lee I just called the cells, and was told they can't tell me who's there or when they'll be released. I asked about getting his keys to feed his cat and was told, probably not. I asked if that was a firm no, or are there channels I can go through to get the keys, and he said they're too busy to worry about cats but maybe I could call later. When I pressed the issue, he said who is it you're calling about? I told him James, and he said call back later. They really don't like James, so I don't know...

Francesca Rogier Amanda, it's up to you to decide what's best here, but if I can make some suggestions, if you can get back there and ask to speak to the officer in command - if they want to know why, say it's because you are very concerned about James' condition. If you can get to that person, work with him as well as possible: start with reasonable questions such as would they give him food if it was dropped off; express concerns for his health as he has lost weight recently, has little money to buy food, etc. (both true).

We just have to keep reminding the police (gently) that these charges stem from peaceful protests, people asserting their rights; if mistakes were made, fine, but they ought to be kept in mind. James is no danger to anyone, and he certainly will not violate conditions overnight...

Rick Van Wrinkle IMHO James should ask the Sargent on duty to have a doctor check him out as they didn't give him a proper check up at the hospital he went to. He said that he might have a concussion but they can't tell. They sure as hell can tell if happens to a hockey player. I would suggest that if no one takes him to the hospital to get checked out for the pains he has been experiencing then someone should write down the symptoms of what he has been experiencing and e-mail these to all city councillors and demand that this man be checked out properly for these injuries.

Francesca Rogier It took the lawyers at HRM three weeks to figure out another (unjust) way to evict me, after I made sure the inspector could not credibly do it. He comes under provincial law. So they just sent orders to by-law and they came the next day - never set eyes on them before, and they said my fence (that the inspector ordered and passed) was no good, and that was a reason for eviction; when I challenged that, they said it was because the house was unsafe. When I asked what was unsafe, they said nothing and threatened me with arrest.

Francesca Rogier I was denied the right of appeal on the excuse that the eviction was done on the "emergency clause" - a clause the law provides for cases where an order to remedy was issued (with 30 days to comply, and a week to appeal) and the owner ignored it. That was never done. The law does not explicitly rule out appeals under any circumstances; it would violate the Charter. But the councilor, Brad Johns, deferred to the HRM lawyer. Who of course had instructions.
I was denied the right to appeal the demolition order as well. They did a lot of very fancy, evil footwork throughout, then told me I had to go to the SUpreme Court to challenge it - which is untrue; I just found out I should have gone to the Nova Scotia Utility and Review Board, they oversee decisions on Heritage property.

Francesca Rogier HRM hit me with four things the day before I went to court to try (in vain) for that injunction (oct. 8, 2010 - the supreme court judge "declined" jurisdiction, by the way - very odd indeed!): around 8:30 am Immigration called me to check status. They knew my status very well; the guy was sarcastic and amused, in fact. Around 9:30, five guys piled out of two cars from by-law, with the inspector, and he pointed vaguely to some cracked wood at the base of the piers - on the ground, where it could not collapse anywhere! - and the piers being a bit crooked - they could also not collapse, by the way - and left. About an hour later I was served with a summons by the woman who seized my dog two weeks earlier (They have begun to use women lawyers, women cops, women dogcatchers, on purpose, notice that??) This is after the Herald published the wrong charges, two days earlier. Then, in the evening as I was trying to prepare for court the next day, HRM dumped me with its enclosure file, which made me ill.

Francesca Rogier After they kicked me out I had no place to go. I have no family or close friends. I was totally stressed out and traumatized already by losing Brindi again. I spent an awful winter, had to move three more times, tried in vain to appeal, finally bought a leaky old RV and froze my butt until I could go back to my house. I actually snuck back in and got thrown out about three or four times - lived in constant fear of the by-law car and the RCMP pulling into my driveway! IT'S MY HOUSE!

They were great, except for one thing: they wanted me to leave my cat by herself all night, in an unheated closet, in a small cage with barely enough room for her litter box and food dishes. I could not do that to her. The city locked her in my house when they evicted me; she was locked in two more times.

They seize her again at the first opportunity - and even the HRM dispatcher tried to help, talked me into filing a report that the other dog attacked Brindi - and they fired her for it, and tried to get me charged with it - which did not work, as they were illegally recording the calls! It gets worse and worse, they stop at nothing.

My contact isn't being charged with it, cause they want it to look like simpson had the weed in his home, when he did not. they got word out to simpson what was going on, and not to come home, or he would be going to prison.

Francesca Rogier BTW, the dogcatcher who took her - not a great guy, really, dispatchers complained about him -was fired, but not for that: he was fired for sending an email to Robert Riley, that Robert gave me to post, saying he did not support his bosses and the way they handled Brindi's case. I ran into him in June 2010 and he told me that he had filed a grievance against them the previous November. He also said the animal services managers are friends with high level men in the mayor's office and the police force, who support whatever they do, no matter what. I guess so!

Ozzy Josh Lucas SPCA sucks. Old neibours of mine had a pitbull and rottie they would abuse constantly. They would ot take them away, and even after getting attacked by the pitbull they still wouldnt take them to a safe home. Mostly because the owners were informants for the cops, so they didnt want to make them upset. police would be there every week, even would mace the dogs. But instead of helping them, they said there was no proof of abuse. even with the scar on my arm, the SPCE still alowed them to keep abusing the dogs :(

I have a friend in Porters Lake whose dog was savaged twice by a boxer belonging to a drug dealer/possible informant in her area. She reported it - vet bills were astronomical, he never paid - and they seized his dog, but he got it back a week later, and taunted her about it. The dog attacked her dog at least two more times.

Around 9:30, five guys piled out of two cars from by-law, with the inspector, and he pointed vaguely to some cracked wood at the base of the piers - on the ground, where it could not collapse anywhere! - and the piers being a bit crooked - they could also not collapse, by the way - and left. About an hour later I was served with a summons by the woman who seized my dog two weeks earlier (They have begun to use women lawyers, women cops, women dogcatchers, on purpose, notice that??) This is after the Herald published the wrong charges, two days earlier. Then, in the evening as I was trying to prepare for court the next day, HRM dumped me with its enclosure file, which made me ill.

Francesca Rogier After they kicked me out I had no place to go. I have no family or close friends. I was totally stressed out and traumatized already by losing Brindi again. I spent an awful winter, had to move three more times, tried in vain to appeal, finally bought a leaky old RV and froze my butt until I could go back to my house. I actually snuck back in and got thrown out about three or four times - lived in constant fear of the by-law car and the RCMP pulling into my driveway! IT'S MY HOUSE!

Francesca Rogier I tried to go to a women's shelter after the second time they threw me out in the dead of winter. They were great, except for one thing: they wanted me to leave my cat by herself all night, in an unheated closet, in a small cage with barely enough room for her litter box and food dishes. I could not do that to her. The city locked her in my house when they evicted me; she was locked in two more times.

Francesca Rogier So imagine, you worked hard all your life, to get into college and graduate, worked every summer, no vacations; worked like a dog at a low-paying teaching job, get overexhausted, decide to change the pace - and adopt rescue dog that was abandoned and abused, work like crazy to train it, did very well, and she's your family and constant companion - and they just come and take it to kill it without trial, without appeal, without a behavioral assessment even! And then they lose in court and keep her, and then start a trial, and pay off the SPCA to keep silent - and then what? They seize her again at the first opportunity - and even the HRM dispatcher tried to help, talked me into filing a report that the other dog attacked Brindi - and they fired her for it, and tried to get me charged with it - which did not work, as they were illegally recording the calls! It gets worse and worse, they stop at nothing.

Online petitions in the thousands, paper petitions from 350 HRM residents, hundreds and hundreds of letters and calls to city hall and the SPCA did nothing.

Robert Blotnicky He went on vacation to europe, and then while he was out of the country, they sized two pounds of weed from my contact, then planted it into Simpson's home, then raided it again. My contact isn't being charged with it, cause they want it to look like simpson had the weed in his home, when he did not. they got word out to simpson what was going on, and not to come home, or he would be going to prison.

Francesca Rogier BTW, the dogcatcher who took her - not a great guy, really, dispatchers complained about him -was fired, but not for that: he was fired for sending an email to Robert Riley, that Robert gave me to post, saying he did not support his bosses and the way they handled Brindi's case. I ran into him in June 2010 and he told me that he had filed a grievance against them the previous November. He also said the animal services managers are friends with high level men in the mayor's office and the police force, who support whatever they do, no matter what. I guess so!

Ozzy Josh Lucas SPCA sucks. Old neibours of mine had a pitbull and rottie they would abuse constantly. They would ot take them away, and even after getting attacked by the pitbull they still wouldnt take them to a safe home. Mostly because the owners were informants for the cops, so they didnt want to make them upset. police would be there every week, even would mace the dogs. But instead of helping them, they said there was no proof of abuse. even with the scar on my arm, the SPCE still alowed them to keep abusing the dogs :(

Francesca Rogier Ozzy, that is a sad and unfortunately familiar story! I have a friend in Porters Lake whose dog was savaged twice by a boxer belonging to a drug dealer/possible informant in her area. She reported it - vet bills were astronomical, he never paid - and they seized his dog, but he got it back a week later, and taunted her about it. The dog attacked her dog at least two more times.

I've copied and pasted a "letter to the editor" meant for the Chronicle Herald from a concerned citizen.
Dear Editor:
I want to thank you for your coverage of yesterday’s brutal and disgraceful - and very possibly unlawful – eviction of Occupy Nova Scotia. As I know all too well what it is like to be the victim of an unlawful eviction, I decided to go to the Halifax police station to await the release of the 14 men and women arrested on Friday. I picked up a copy of the Herald on the way home. As this shameful action will doubtless be recalled on Remembrance Day for years to come, I thought the following might be a matter of interest for your readers.
As your report indicates, HRM police took into custody at the Gottingen Street detachment sometime around 3:30 pm on Friday, charging each with “obstruction of justice”. Hearing they would be released around 11 pm, I went to the station that evening and waited quietly outside with about 25 others, among them the family of an 18 year old from New Glasgow. No journalists were present.
But 11 pm came and went, and still no one was released. Police apparently “processed” the arrestees one at a time. They insisted that they were not processing the ONS arrestees any slower than usual. However, they did not begin releasing them until around 1:30 am – and in ones and twos, about every hour. As for the speed of processing, another man (not part of ONS), was released after being charged for for cocaine possession and held for about an hour.
Also, police initially said they would be holding the two minors in the group, homeless boys aged 16 and 17, overnight. After we had a chance to assure them the boys would have a place to sleep at St. Andrews church, they were released, but not until around 3:30 am. By the time I left at 4 am, two were still in custody, including the only American in the group, who was the only one forced to pay a bail, which police set at $500. The other had been in direct communication with HRM police since the start of the occupation, Oct. 15, and had become a frequent subject of interviews by local media.
The Herald article mentioned that protesters complained about police punching peaceful protesters in the face and lifting them from the ground using chokeholds. I was told the same by many ONS participants during the course of the evening, in disturbing detail - yet also said “None appeared to be injured.” I find it hard to believe that your reporters did not take the trouble to find out that some of those punches and chokeholds were used on young girls, whose necks are now bruised quite badly. It is also perplexing that your reporters apparently missed the fact that protesters had occasion to call EMS was called to the scene to treat at least two people for injuries caused by police using excessive force. One was the 18 year old female, who was apparently hit in the chest hard enough to cause difficulty breathing and bruising. I believe she was one of the three your article described as being dragged through the mud.
The other protester treated by EMS is a tall 230 pound man, known to police for his daily video posts – which include a friendly interview with the mayor during the first week of the occupation. Others recorded this man being tackled by police;. He only recalls waking up in the paddy wagon. EMS found that he had an injured wrist, two sprained or dislocated shoulders, a dislocated jaw, and a concussion, among others. Multiple witnesses say neither she nor the man injured taunted or assaulted police or actively resisted arrest. The public doesn’t have to take their word for it; they can decide for themselves with the aid of audio interviews of the arrestees on the media co-op website and videos of the event posted there and elsewhere. Two of the other protesters also say they heard and saw one cop taunting the injured man, calling him “Candy-ass”, etc., in an attempt to get him to attack him - doubtless so that further criminal charges could be laid. The man resisted the temptation, thankfully.
Each protester arrested was told they would not be released until they signed a statement that appears to bind them to “conditions” banning them from every public park in HRM. And most of them say they were not read their rights at the time of arrest; only a few said they were read once they were in custody at the police station. The homeless boys have no idea when and how they will get their belongings back.
I am too tired to continue, but I believe the public would be very dismayed by the full details of the heavy-handed forced eviction of these people – who the mayor so brazenly implied are not part of the general public.
I believe most Haligonians are by now aware that ONS occupiers scrupulously kept their end of the bargain. On Nov. 11, we learned that the mayor never had any intention of honoring his word - which he changed from day to day. I now know that HRM police went much further than that, so that Kyle Buott’s words apply universally.
I hope that residents of Halifax give serious thought to these things before making their minds up about ONS – and about Mayor Peter Kelly.

Now we know why court was delayed poor Frannie on pain meds,well it hasn't slowed her up on twitter I have heard of lame excuses before but that tops the list. With all the monet she has scammed people out of I would think she could hire a taxi;or have a neighbour friend drive her............but oh wait she has no friends in HRM. "Robert Riley When you smash your finger and the doc puts you on pain med it is not a good idea to drive a car from where she lives.And I have driven with her a few times and I would not like to be with her on pain meds.My opinion only."

She went to the doctor, they told her not to use it for a few days. So she sent the medical report to the judge and asked me to go there this afternoon to ask for an adjournment for her. I guess the HRM lawyer was against adjournment but the judge looked at the paper and said it was acceptable. Francesca is not happy about the new date. The courts are so booked up. If there is another way to get Brindi home sooner, I think she needs a good rest first so she can heal her finger. And she asked me to thank you all for all the support, prayers, and letters. Thank you!""

Several of us thought Fran would pull some trick to delay however this is now going beyond all common sense on her part,or is she just plain stupid? Well now, it could be more time to collect more $ who knows with the leach.
